By accessing or using CommentFlow ("Service"), operated by CommentFlow("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

CommentFlowis a SaaS platform that provides Instagram automation tools including automated comment replies, direct message automation, and chatbot builders. The Service integrates with Instagram's API to perform these functions on your behalf.

3. Account Registration

You must provide accurate information when creating an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

4. Instagram API Usage

By connecting your Instagram account, you authorize CommentFlow to:

• Access your Instagram Business or Creator account data
• Send direct messages on your behalf
• Read and respond to comments on your posts
• Access your account insights and analytics

You must comply with Instagram's Terms of Use and Community Guidelines at all times. We reserve the right to suspend your access if your usage violates Instagram's policies.

5. Acceptable Use

You agree NOT to use the Service to:

• Send spam, unsolicited messages, or bulk automated messages
• Harass, threaten, or abuse other users
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Distribute malware or harmful content
• Circumvent rate limits or usage restrictions

6. Service Limits

The Service may impose limits on usage including daily message limits, chatbot count, and API call frequency. These limits vary by subscription plan and are subject to change. We reserve the right to throttle or suspend accounts that exceed reasonable usage.

7. Payment and Billing

Paid plans are billed in advance on a monthly or annual basis. Refunds are handled on a case-by-case basis. We reserve the right to change pricing with 30 days notice. Free tier usage is subject to limitations as described in our pricing page.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We process data from your Instagram account solely to provide the Service.

9. Intellectual Property

The Service, including its design, code, and content, is owned by CommentFlow and protected by intellectual property laws. You retain ownership of your content and data.

10. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation. We are not responsible for actions taken by Instagram, Meta, or third parties that may affect the Service.

11. Limitation of Liability

To the maximum extent permitted by law, CommentFlow shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

12. Termination

We may suspend or terminate your account at any time for violation of these terms. You may cancel your account at any time through your account settings. Upon termination, your data will be deleted within 30 days.

13. Changes to Terms

We may update these terms at any time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance.

14. Governing Law

These terms are governed by the laws of the United States. Any disputes shall be resolved in the competent courts of the jurisdiction where CommentFlow is incorporated.
